Pre-order Terms

These Pre-order Terms apply when a HostingBuY location or service is offered before normal production activation.

1. What a Pre-order means

A Pre-order reserves the Customer’s selected hosting package at a selected HostingBuY location before that location enters production. Each location has a planned Pre-order capacity. Current occupancy and package availability can be followed on the Locations page.

2. Capacity threshold and server deployment

HostingBuY accepts Pre-orders until the planned capacity for a location is reached or ordering is otherwise closed. Once the planned Pre-order capacity for the selected location has been filled, HostingBuY deploys and prepares the server for production. Service activation follows completion of deployment, provisioning and required operational checks.

3. Payment and start of the service term

The checkout states when payment is collected. The paid hosting service term does not run while the Customer is waiting for the Pre-order location to be activated. Unless the order explicitly states otherwise, the service term begins only when the hosting service is activated on the deployed server.

4. Pre-order support benefit

As a thank-you for supporting a HostingBuY location during its Pre-order phase, the current Pre-order offer includes one additional year of hosting service at no additional hosting charge for qualifying two-year and three-year orders:

• 2-year order + 1 year free — 3 years of hosting service in total, counted from activation.
• 3-year order + 1 year free — 4 years of hosting service in total, counted from activation.

The additional year is added to the end of the paid service term, has no cash value, is not separately refundable or transferable and applies only to an eligible Pre-order that remains valid through activation.

5. Location availability

Pre-order availability is limited by the physical and planned allocation of each location and package. HostingBuY may stop accepting new Pre-orders when the relevant allocation has been reached, ordering has been disabled or the location can no longer accept the requested package.

6. Activation changes or unavailable location

If the selected location cannot be launched within a reasonable period, HostingBuY may offer an alternative location, allow the Customer to continue waiting or provide a refund for the unactivated Pre-order, subject to mandatory law and the circumstances of the order.

7. Cancellation before activation

Pre-orders that have not yet been activated may be cancelled and refunded where stated during checkout or required by applicable law. Payment-provider, currency-conversion or bank fees outside HostingBuY’s control may not be recoverable.

8. After activation

After service activation, the ordinary Terms and Conditions of Service and Cancellation & Refund Policy apply, including any mandatory consumer rights. The additional free year forms part of the service duration but does not create a separately refundable monetary amount.

9. Abuse and eligibility

Pre-order status does not exempt a Customer from fraud screening, the Acceptable Use Policy or other service rules. Fraudulent, abusive or ineligible orders may be cancelled.
