Terms and Conditions of Service

These Terms and Conditions of Service (the “Terms”) govern the purchase and use of HostingBuY services operated by CirculeForce GmbH, Zurich, Switzerland (“HostingBuY”, “we”, “us” or “our”). By placing an order, creating an account or using a HostingBuY service, the customer (“Customer”, “you” or “your”) agrees to these Terms, the Acceptable Use Policy, Privacy & Data Processing Policy, applicable Pre-order Terms and Cancellation & Refund Policy.

1. Scope of services

HostingBuY provides shared web hosting and related services, including storage, bandwidth, databases, e-mail, control-panel access, SSL support, backups where specified, technical support and other features described for the selected package. Services, resources and included features are those shown on the product page, Compare page, order summary or written offer at the time of purchase.

Shared hosting is a multi-tenant environment. Customers receive defined service allocations and may not use the platform in a way that materially degrades the stability, security or availability of other customers or the underlying infrastructure.

2. Orders and contract formation

Before an order is submitted, the Customer must be able to review the selected service, billing period, price and entered information and correct errors. A binding contract is formed when HostingBuY accepts the order and confirms it electronically, unless the checkout or written offer expressly states another point of contract formation.

The Customer is responsible for providing complete and accurate account, billing and contact information and for keeping it current.

3. Prices, currencies, taxes and payment

Prices are displayed in the currency shown during checkout. Taxes, duties, payment-provider fees and currency-conversion charges are handled as stated in the order summary and according to applicable law. The Customer is responsible for any bank, intermediary-bank or currency-conversion fees not charged by HostingBuY.

Services may require advance payment. HostingBuY may suspend or delay activation when payment is missing, reversed, disputed or cannot be verified. Fraudulent chargebacks or payment abuse may result in immediate account restriction while the matter is investigated.

4. Service activation and billing term

Standard services are activated after successful order acceptance, payment verification and any required fraud or identity checks. Pre-order services are activated according to the applicable Pre-order Terms. The service term begins on the activation date unless the order explicitly states otherwise.

Renewal, expiration and non-payment rules are shown during checkout, in the customer account or on the invoice. Customers are responsible for renewing services before expiration where automatic renewal is not enabled.

5. Hosting packages and resource allocation

HostingBuY uses defined package limits instead of artificial “unlimited” resource claims. Disk capacity, monthly bandwidth and other technical limits are package-specific. Published capacity and location availability may change as infrastructure is expanded or filled.

Resources may not be pooled, resold or used outside the intended shared-hosting purpose unless HostingBuY has expressly agreed otherwise.

6. Customer responsibilities

• Maintain secure passwords, applications, plugins, themes, scripts and account credentials.
• Keep software reasonably current and remove abandoned or vulnerable applications.
• Maintain independent backups of important data even where HostingBuY provides backup functionality.
• Use services only for lawful purposes and in accordance with the Acceptable Use Policy.
• Respond promptly to security, abuse, billing and administrative notices.
• Ensure that content, software and data uploaded to the service may lawfully be used, stored and distributed.

7. Backups and data recovery

Where backups are included, they are a convenience and resilience feature rather than the Customer’s sole backup strategy. Unless expressly guaranteed in writing, HostingBuY does not warrant that every file, database, mailbox or restore point can always be recovered. Customers should maintain independent copies of business-critical data.

8. Maintenance, changes and availability

HostingBuY may perform scheduled or emergency maintenance and may replace, upgrade, migrate or reconfigure infrastructure where reasonably necessary for security, performance or continuity. We aim to minimize disruption, but uninterrupted availability cannot be guaranteed.

If a material service change substantially reduces the contracted service, HostingBuY will provide information or remedies required by applicable law and the relevant contract.

9. Technical support

Support covers the HostingBuY platform and the service scope published for the selected package. Unless expressly included, support does not include custom software development, debugging third-party applications, website design, business consulting or administration of systems outside HostingBuY infrastructure.

10. Acceptable use and prohibited activity

The Customer must comply with the Acceptable Use Policy. Prohibited activity includes, among other things, child sexual abuse material or sexual exploitation of minors, phishing, malware, ransomware, credential theft, botnets, unauthorized access attempts, DDoS activity, spam, fraud, scams, identity theft, unlawful gambling operations, criminal marketplaces, unlawful sale of controlled or prohibited goods, systematic copyright or trademark infringement, distribution of stolen data, carding, terrorist operational support, and other unlawful or seriously abusive activity.

HostingBuY may also restrict workloads that are technically incompatible with a shared-hosting environment, including sustained resource abuse, unauthorized public proxies, abusive automated scanning or cryptocurrency mining, where such use threatens platform stability or is prohibited by the applicable package or Acceptable Use Policy.

11. Suspension, investigation and reporting

HostingBuY may immediately suspend, isolate or restrict a service without prior notice where there is a credible indication of serious unlawful activity, security compromise, fraud, phishing, malware distribution, child sexual abuse material, attacks against third parties, imminent infrastructure risk or another serious breach.

During an investigation HostingBuY may preserve relevant technical logs and evidence, restrict access, request additional information and cooperate with upstream providers, payment providers, rights holders and competent authorities where legally permitted or required. Where conduct reasonably appears criminal, HostingBuY may report the matter or file a criminal complaint with the competent authorities.

Suspension is not a finding of criminal liability. Where appropriate, HostingBuY may restore service after the issue is resolved and the risk is removed.

12. Intellectual property and third-party rights

Customers retain rights in their own lawful content. Customers must have all permissions required to host, reproduce and distribute their content. HostingBuY may act on sufficiently substantiated notices of infringement and may remove or restrict allegedly infringing material where required by law or reasonably necessary to protect the service and third parties.

13. Security and compromised accounts

If HostingBuY detects or reasonably suspects compromise, malicious code or abuse, it may reset credentials, isolate files, disable affected components, block traffic or suspend the service until the risk is remediated. The Customer must cooperate with reasonable remediation instructions.

14. Cancellation, refunds and termination

Customer cancellation and refund rights are governed by the Cancellation & Refund Policy and, for pre-orders, the Pre-order Terms. HostingBuY may terminate or suspend services for material breach, serious abuse, non-payment, fraud, repeated security negligence or unlawful activity, subject to mandatory law.

Following termination, data may be deleted after the applicable retention or grace period. Customers must export required data before service expiration or termination.

15. Privacy and data processing

Personal data is processed according to the Privacy & Data Processing Policy. Where HostingBuY processes personal data on behalf of a business customer as processor, the Data Processing Agreement applies where required or agreed.

16. Third-party services

HostingBuY may use data centers, network providers, domain registries, control panels, security services, payment providers and other third parties. Their availability and terms may affect specific service components. Third-party licences or services may also be subject to their own mandatory terms.

17. Liability

HostingBuY is responsible only to the extent provided by the contract and applicable mandatory law. To the extent legally permitted, HostingBuY is not liable for indirect or consequential loss, lost profit, loss caused by Customer software or configuration, unlawful Customer content, third-party outages, force-majeure events or data loss that could reasonably have been prevented by maintaining independent backups.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

18. Force majeure

HostingBuY is not responsible for delay or failure caused by events outside its reasonable control, including natural disasters, war, civil disturbance, major internet or power failures, upstream provider failures, government action or widespread cyber incidents, to the extent permitted by law.

19. Changes to these Terms

HostingBuY may update these Terms for legal, security, operational or commercial reasons. Material changes affecting an active contract will be communicated as required by law or the contract. The version applicable to an order should be retained with the relevant contract record.

20. Applicable law and jurisdiction

These Terms are governed by Swiss law, subject to mandatory consumer-protection and jurisdiction rules that cannot validly be excluded. For business customers, the courts at the registered seat of CirculeForce GmbH are intended to have jurisdiction unless a mandatory rule provides otherwise.
